1. Who we are
1.1 Boatomation is a commercial name of , a company established in the Principality of Andorra (the Company, we, us). We design and install automation, control and monitoring systems aboard privately owned yachts.
1.2 For the purposes of Regulation (EU) 2016/679 (GDPR) and of Andorran Llei 29/2021 on the protection of personal data, the Company is the controller of the personal data described in this notice.
1.3 You can reach us about anything in this document at .
2. What this notice covers
2.1 This notice covers the website at boatomation.com and the two forms on it: the quote request and the contact form.
2.2 It does not cover the systems we install aboard a vessel. Those are described in §8, and the position there is different in a way that matters: for data produced by equipment aboard your own boat, in almost all cases you are the controller and we are not.
3. The short version
We collect what you type into one of our two forms, plus the technical details any web server sees. We use it to answer you and to prepare a quotation. We do not sell it, we do not advertise with it, and we do not profile you. There is no advertising cookie, no analytics script and no third-party tracker anywhere on this site.
4. What we collect, exactly
4.1 The quote request (/quote)
The wizard collects, in this order:
- Who you are in the project — owner, captain, broker, yard or manager, and a company name if you give one.
- The vessel — type, builder and model as you write it, length overall, year built, number of cabins and heads.
- Her situation — whether she is being planned for, in refit or in commission; whether new cable can be run through her; roughly when you want the system working; and the country and port or marina where she lies.
- Decks and spaces — for each space you list: its type, the name you give it, and the number of light circuits, dimmed circuits, blinds, air-conditioning zones, cameras and panels you want in it.
- What you want controlled and how you want to control it, your stated priorities, and a budget band if you choose to give one.
- Contact details — first and last name, email address, telephone number, country, preferred means of reply, and any free-text message you write.
- Your acceptance of this notice and of the Terms: the version accepted and the moment you ticked the box, recorded as a UTC timestamp.
The berth is a port or marina, not a berth number, and we do not ask for one. We never ask for a vessel's registration, MMSI, insurance details or any document number through this website.
4.2 The contact form (/contact)
Name, email address, telephone number, company, country, the boat and year if you give them, a subject line, your message, and your preferred means of reply.
4.3 The photographs and description you send us
Our first step is that you send us a description of the Vessel's spaces and photographs of them, by email (see clause 5.1 of the Terms). Those photographs are personal data in our hands, and two things about them are worth stating plainly:
- Please photograph the boat, not the people. We need spaces, panels, lockers and cable runs. We do not need, and would rather not have, images of you, your family, your crew or your guests.
- They may nonetheless show personal possessions, documents or people by accident. We treat everything you send as confidential, use it only to price and design the work, and never publish any of it — publicity is governed by clause 21.9 of the Terms and needs your written permission.
They are held on the same EU infrastructure as everything else in this notice, seen only by the engineers who need them, and deleted on the retention schedule in §6 — or sooner, on request, once we have quoted.
4.4 Technical data, captured automatically
With any submission we record the originating IP address, the browser user-agent string, the referring page and the site language you were reading in. The first three are kept as evidence of how and from where a request reached us; the fourth is kept so that a human being answers you in your own language.
4.5 Special categories
We do not ask for and do not want any special category of personal data (health, beliefs, biometrics and the rest). Please do not put any into a free-text box.
5. Why we use it, and on what legal basis
| Purpose | Data | Legal basis |
|---|---|---|
| Answering you and preparing a quotation | Everything in §4.1 / §4.2 | Steps taken at your request prior to a contract — GDPR art. 6(1)(b) |
| Studying the Vessel and giving you an indicative price range | The photographs and description in §4.3 | Steps taken at your request prior to a contract — art. 6(1)(b) |
| Sending you an acknowledgement carrying your reference | Name, email, reference | Art. 6(1)(b) |
| Keeping a record of who asked for what, and when | Submission, IP, user-agent, referrer, timestamp | Legitimate interests — art. 6(1)(f): defending against and evidencing disputed or abusive submissions |
| Recording acceptance of this notice and the Terms | Version and UTC timestamp of the tick | Legal obligation and art. 6(1)(f) |
| Accounting, once you become a client | Identity and billing data | Legal obligation — art. 6(1)(c) |
We do not send marketing email. If we ever do, it will be on separate, explicit, withdrawable consent, and never by adding you to a list because you once asked for a quote.
6. How long we keep it
| Record | Retention |
|---|---|
| A quote or contact request that does not become a project | 24 months from the last contact, then deleted |
| Photographs of the Vessel (§4.3) | 12 months from our last quotation, then deleted — or immediately on request once we have quoted |
| A request that becomes a project | For the life of the project and 6 years after final delivery |
| Accounting records | As required by Andorran tax law (currently 6 years) |
| Evidence of acceptance of the Terms | 6 years from acceptance |
7. Who else sees it
7.1 Our own staff and contracted engineers, to the extent they need it to answer you or to design the work.
7.2 Our hosting and mail providers, acting as processors under art. 28 GDPR contracts. The website and its data store run on Microsoft Azure infrastructure in the European Union.
7.3 Where a project involves a yard, a marina or a surveyor, only with your knowledge, and only what that party needs.
7.4 A public authority, where we are legally required to disclose.
7.5 Nobody else. We do not sell, rent or trade personal data, and we do not share it with advertising networks or data brokers — there are none on this site.
8. Systems installed aboard your vessel
8.1 The systems we install — cameras, sensors, controllers, panels and the application that speaks to them — run on equipment that belongs to you and, where a cloud service is used, under an account that belongs to you. For the data they produce you are the controller: what is recorded, who may see it and how long it is kept are your decisions, not ours.
8.2 This matters most for cameras. If a camera can see a pontoon, a neighbouring vessel or any place outside your own boat, you are responsible for the lawfulness of that recording — including signage, minimisation and the rights of anyone filmed. We will advise on placement and will decline to install a camera where the intended coverage is obviously unlawful, but the decision and the duty are yours.
8.3 If a crew member's working time, movements or conduct can be inferred from the system, employment and workers' privacy rules apply to you as their employer. Tell them, before it is switched on.
8.4 The System runs on a server installed aboard your Vessel, on her own network. It does not need an internet connection to work, and the data it produces stays aboard: it is not collected by us and it does not pass through us in the ordinary course. A connection, where she has one, is what lets you reach her from a distance.
8.4.1 When we support or diagnose the System remotely, we can see that data. For that we act as your processor: on your instructions, only to support and secure the System, never for our own purposes, and we keep no copies beyond what the job requires. The terms of that processing form part of the separate licence under which the software is supplied.
8.5 Where a manufacturer's own cloud service is part of a system (a camera platform, a voice assistant, a music service), that manufacturer is a controller in its own right for what passes through it, under its own notice. We will tell you which ones a given design involves before you commit to it.
9. Transfers outside the EEA
The Company is established in Andorra, which the European Commission has recognised as providing an adequate level of protection (Decision 2010/625/EU). Data therefore moves between the EU and Andorra without further safeguards. Where a processor is outside both, we rely on the Commission's Standard Contractual Clauses.
10. Your rights
You may ask us to give you a copy of your data, correct it, delete it, restrict or object to our use of it, or send it to someone else in a portable form. Ask at . We answer within one month. We will not charge you, and we will not ask you to explain why.
11. Complaining
If you think we have handled your data badly, tell us first — it is usually faster. You may also complain to the Andorran Data Protection Agency (Agència Andorrana de Protecció de Dades, apda.ad), or to the supervisory authority of the EU member state where you live or work.
12. Cookies
This site sets two cookies, both strictly necessary, both first-party, and neither used to identify or track you:
| Cookie | Purpose | Life |
|---|---|---|
boa_lang | Remembers the language you chose, so you are not sent back to English on every page | 12 months |
boa_theme | Remembers the colour palette you chose | 12 months |
Because both are strictly necessary for a function you asked for, no consent banner is required and there is none. There is no analytics, advertising or social cookie on this site, and no script is loaded from a content delivery network.
13. Security
Traffic is encrypted in transit. Stored data sits in an access-controlled database in the EU. Access is limited to people who need it. The endpoint this site talks to is authenticated and is not reachable from the public web without its credential.
14. Children
This site is aimed at adults buying or managing a vessel. We do not knowingly collect data from anyone under 16. If you believe we have, write to us and we will delete it.
15. Changes
If we change this notice we will change the version and date at the top. The version in force when you submitted a form is the one that governs that submission, and we keep a record of which that was.
